This is an application for bail pending final hearing and disposal of the Appeal. The Applicant along with his mother had earlier filed a Criminal Application No.773 of 2018 in Criminal Appeal No.547 of 2018 for his release on bail during pendency of appeal. That time his mother was granted bail. His own application was not pressed. Liberty was given to him to approach this Court again after one year of passing of that order dated 12/09/2018. The appeal was not listed for hearing within that time and, therefore, Interim Application No. 776 of 2019 was Digitally signed by VINOD BHASKAR GOKHALE Date:

08-ia-776-19 preferred. This Court (Coram: Bharati Dangre, J.) has expressed disinclination to grant relief in that application. A request was made to hear the appeal. The applicant was in custody for more than three years. On 25/06/2021 the order was passed to list the appeal for final hearing on 20/09/2021. It appears that the matter was not heard even after that. Considering the previous orders passed, it is necessary that the matter is heard finally at the earliest.

Hence, the following order is passed:

O R D E R

i) List the Criminal Appeal No.547 of 2018 on the weekly final hearing board commencing from 22/08/2022; at the request of learned counsel for the appellant. ii) In view of this order, learned counsel for the applicant does not press this I.A.No.776 of 2019 in Criminal Appeal No.547 of 2018 and is accordingly disposed of as withdrawn.
