The Respondent No.2-Deputy Director of Education, Kolhapur has passed a common Order for three proposals, which is the subject matter of this Petition.

It is stated by the Respondent No.2-Deputy Director of Education in the impugned Order that the proposals can not be approved for the present, as there are several deficiencies.

In our opinion, the Respondent No.2-Deputy Director of Education before taking any decision on such proposals, ought to have given an opportunity to the Petitioners. In such view of the matter, the impugned Order dated 18th September 2023, which is at page 56 of the Petition, can be treated as a Show-Cause-Notice to the Petitioners. The Petitioners shall cure / explain the deficiencies mentioned in the proposals within a period of three weeks from today.

Within a period of three weeks thereafter, the Respondent No.2Deputy Director of Education shall inform the Petitioners in case there are any further additional deficiencies. The Management shall within a period of two weeks thereafter cure / explain the additional deficiencies. The proposal qua the Petitioner No.1 be considered afresh and decided as expeditiously as possible and in any case, within a period of 16 weeks from the date of communication of this Order. 6.
