By this application the applicant is apprehending arrest in crime no.538 of 2024 registered with Barshi City Police Station Dist- Solapur Gramin for offences punishable under Sections 3, 4, 5 and 6 of Immoral Traffic (Prevention) Act, 1956 and Section 143(2) and 144(2) of Bharatiya Nyaya Sanhita, 2023. 2.

It is prosecution's case that the applicant is the lodge owner where she was running prostitution and she detained the victims in her lodge for prostitution.

Learned counsel for the applicant submits that the applicant was not aware about the prostitution was going on in 1/3

her lodge. This Court while granting interim relief to the applicant, has considered all the facts. The applicant is on interim relief from 9 months. She has co-operated in the investigation. Hence, requested to allow the application. 4.

Learned APP strongly objected to allow the anticipatory bail application on the ground that applicant has antecedents of same nature. Considering the allegations against the applicant, her custodial interrogation is required and requested to reject the application.

I have heard all the learned counsel, perused the FIR and documents produced on record.

Whether the applicant was aware about the prostitution was going on in her lodge or not is the part of trial. Considering the allegations against the applicant, custodial interrogation of the applicant is not required and I pass following order :

O R D E R

I.

Application is allowed.

II.

Order passed by this Court (Coram : Manish Pitale J.) dated 20th December, 2024 is made absolute.

III. In the event of arrest, applicant be enlarged on 2/3

bail in C.R. No.583 of 2024 registered with Barshi City Police Station, Dist. Solapur Gramin on furnishing P. R. Bond in the sum of Rs. 50,000/- with one or two sureties in the like amount.

IV.

The applicant shall attend the concerned police station as and when required.

V.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

VI.

Application is disposed of in above terms.

VII. All concerned to act on authenticated copy of this order.
