JUDGMENT

This Appeal was originally filed as A.S.No.166 of 1987 on the file of the District Court, Salem, and subsequently transferred to this Court vide order of this court dated 12.11.1992 in Tr.CMP No.9171 of 1990 and renumbered as A.S.No.1042 of 1993, to be tried along with A.S.No.1003 of 1989.

2. It is represented by the counsel for the appellants that nothing survives in this appeal as the connected appeal in A.S.No. 1003 of 1989 has already been disposed of by this Court on 12.07.2004 and also made an endorsement to that effect.

3. In the light of the above position, the first Appeal is dismissed as infructuous. Consequently, connected miscellaneous petition, if any,is closed.
