When the matter is taken up for hearing, learned counsel for the petitioner submitted that the petitioner had passed away and he has also filed Page No.1 of 3

substitute petition to bring the legal heirs of the deceased petitioner on record. He further submitted that he has been instructed by the legal heirs of the deceased petitioner that not to pursue the matter. Hence he sought permission of this Court to withdraw this writ petition and also made an endorsement to that effect in the Court bundle.

2. Recording the submission made by the learned counsel for the petitioner and also in view of the endorsement made in the Court bundle, this writ petition is dismissed as withdrawn with liberty to reopen the same, if need arises. No costs. Consequently connected miscellaneous petitions are also closed.
