The learned Government Advocate (Criminal Side) stated that the statement under Section 164(5) of Code of Criminal Procedure had not yet been recorded on the victim child.

2. The abovesaid submission made by the learned Government Advocate (Criminal Side) has been recorded. In this case, the application seeking anticipatory bail will not lie.

3. Accordingly, this Criminal Original Petition stands dismissed.
