O R D E R

The petitioners, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 25 1(A) of Arms Act, 1959, in Crime No.183 of 2025 on the file of the respondent Police, seek anticipatory bail.

The case of the prosecution is that there was a wordy quarrel between the petitioners and the complaint due to a family dispute. While so, when the complainant's daughter was alone at home, the petitioners fired a shot over the complainant's compound wall with a country gun. Hence, this case.

The learned counsel appearing for the petitioners would submit that this is third anticipatory bail application and the earlier criminal original petitions in Crl.O.P.No.25721 of 2025 seeking anticipatory bail was dismissed by this Court on 19.09.2025. He further submitted that the petitioners have not committed any offence as alleged by the prosecution and have been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioners reiterated the prosecution case and that the investigation is pending. 5.The first anticipatory bail application in Crl.O.P.No.23003 of 2025 has been dismissed by this Court by an order dated 20.08.2025 on the 2/4

following reasons:

"5.Considering the nature of the offence, there is likelihood of the petitioner absconding unless and until he is arrested. Further, since the gun used for intimidation has been recovered, there is always a threat to the de-facto complainant. Therefore, this Court is not inclined to grant anticipatory bail. Accordingly, this Criminal Original Petition is dismissed."

Heard the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order. Accordingly, this criminal original petition stands dismissed.
