ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS Act in Crime No.452 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2. Earlier this Court vide order dated 13.10.2025 in Crl.O.P.No.27798 of 2025, had dismissed the anticipatory bail petition filed by the petitioner with

the following observations:

"5. Considering the facts and circumstances of this case, taking note of the fact that the sand was illegally taken from river, thereby damaging the river bed, affecting the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner."

3. Now the petitioner has filed this second anticipatory bail petition without any change in circumstance, hence, I am not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, this Criminal Original Petition seeking anticipatory bail is dismissed.
