ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS Act in connection with the Cr.No.453 of 2025, seeks anticipatory bail.

2. This Court on 13.10.2025 vide Crl.O.P.No.27793 of 2025 had dismissed the anticipatory bail application filed by the petitioner, with the following the observations:

"5. Considering the facts and circumstances of this case, taking note of the fact that the sand was illegally taken from river, thereby damaging the river bed, affecting the ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner"

3. The learned Government Advocate (Crl.Side) appearing for the respondent police on instruction submitted that the petitioner has filed this second anticipatory bail petition without any change in circumstances.

4. Since, there is no change in circumstances, I am not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition stands dismissed. 12-01-2026 jai
