ORDER

The petitioner, who apprehends arrest by the respondent police for the offences punishable under Sections 318(4) of BNS (Sections 420 of IPC) r/w

Section 15 & 15(3) of Indian Medical Council Act 1956, in Crime No.422 of 2025 seeks anticipatory bail.

2.The case of the prosecution is that the petitioner, who is a Homeopathy Doctor, has been practising Allopathy without registration before the Medical Council, thereby cheating the general public. Hence, the competent authority has lodged the present complaint.

3. Earlier, this Court has considered the case of the petitioner on merits and dismissed the same by an order dated 19.11.2025 in Crl.O.P.No.30567 of 2025 and without any change in circumstances, this second successive anticipatory bail application has been filed.

4. This Court, while dismissing the earlier anticipatory bail application has observed as follows:

"6.Considering the submissions made and also the fact that, if the petitioner is granted anticipatory bail, he may continue to engage in similar activities which could endanger the general public, I am not inclined to grant anticipatory bail to the petitioner.

7.Accordingly, this Criminal Original Petition is dismissed."

5. So far, there is no change in circumstances for reconsidering the above observation, this Court is not inclined to grant anticipatory bail to the petitioner. 6 .
