ORDER
The petitioner/wife seeks transfer of O.P.No.494 of 2023 pending on the file of the Subordinate Court, Poonamallee to be transferred and taken up by the Subordinate Court, Ranipet.
2.I have heard Mr.Ganesh for Mr.K.Jayaraman, learned counsel for the petitioner. Despite service of notice on the respondent,the respondent has not chosen to enter appearance either in person or through counsel. The Registry has also printed the name of the respondent in today's cause list. 3.The learned counsel for the petitioner would submit that the petitioner is the wife and she resides at Ranipet. Alleging physical abuse and assault, the petitioner has also lodged a complaint before the All Women Police Station at Ranipet. However, subsequently, with ulterior motive and in order to harass the petitioner, the respondent has chosen to file a divorce OP on the file of the Sub Court, Poonamallee in O.P.No.494 of 2023. The petitioner has stated that she has to take care of her ailing 2/4
mother and as a lady, it would be very difficult to her to travel all the way from Ranipet to Poonamalle to attend the hearings in the OP. 4.I have gone through the affidavit filed in support of the transfer petition and I am prima facie satisfied with the averments set out therein. In any event, the respondent has not chosen to appear to even controvert any of these averments set out in the affidavit.
5.In the light of the above, this Transfer Civil Miscellaneous Petition is allowed. The case in O.P.No.494 of 2023 is hereby withdrawn from the file of the Subordinate Court, Poonamallee and transferred to the file of the Subordinate Court, Ranipet. There shall be no order as to costs. Connected Civil Miscellaneous Petition is closed.
