O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 123 of BNS, 2023, and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003, in Crime No.272 of 2025 on the file of the respondent Police, seeks anticipatory bail. 1/4

The case of the prosecution is that the petitioner was found in possession of 42 kgs of tobacco products without valid permission. Hence, this case.

The learned counsel appearing for the petitioner would submit that this is third anticipatory bail application and the earlier criminal original petitions in Crl.O.P.No.29832 of 2025 seeking anticipatory bail was dismissed by this Court on 03.11.2025. He further submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4. Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner reiterated the prosecution case and submitted that the petitioner illegally possessed 42 kgs of tobacco products and one previous case is pending against the petitioner.

5.The first anticipatory bail application in Crl.O.P.No.28537 of 2025 has been dismissed by this Court by an order dated 17.10.2025 on the 2/4

following reasons:

"5.Considering the submissions of the learned counsel on either side, that one previous case is pending against the petitioner and it is similar in nature, and this Court is not inclined to grant anticipatory bail to the petitioner."

Heard the submissions made on both sides and perused the materials available on record.

Considering the facts and circumstances of this case, gravity of offence, the fact that there is no change in the circumstances, this Court is not inclined to revisit the earlier order. Accordingly, this criminal original petition stands dismissed.
