O R D E R

This writ petition has been filed to direct the respondents 1 to 4 not to shift the Government Lower Primary School, Mahe from its existing place to its new place as decided by the respondents and further direct the respondents to permit to function Government Lower Primary School, Mahe in the place which is now functioning.

2. Mr.R.S.Syed Mustafa, learned Special Government Pleader (Puducherry) takes notice for the respondents.

3. In view of the consent expressed by the learned counsel appearing on either side, this petition is taken up for final disposal.

4. The case of the petitioner is that in Government Lower Primary Page No:2/6

School around 250 students are studying. When Government has taken steps to shift the Government Lower Primary School to some other building, petitioner had made a representation dated 18/1/2024 to the Chief Minister of Puducherry and to all the respondents. Since the same has not been considered so far, petitioner has come forward with the instant writ petition.

5. Heard Mr.A.Gouthaman, learned counsel for the petitioner and Mr.R.Syed Mustafa, Special Government Pleader (Puducherry) for the respondents.

6. The learned counsel appearing for the petitioner submits that it would be suffice if this Court issues a direction to the fourth respondent to consider the petitioner's representation dated 18/12/2024 and pass orders on the same within a particular time frame fixed by this Court.

7. The learned Special Government Pleader (Puducherry) has no objection for thesaid order being passed and he fairly conceded that the petitioner's representation dated 18/12/2024 will be considered and appropriate orders will be passed within the time stipulated by this Court. Page No:3/6

8. In view of the above, this Court without expressing any opinion on the merits of the case directs the fourth respondent to consider the petitioner's representation dated 18/12/2024 and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

9. This writ petition is accordingly disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 6/1/2025 mvs.
