When the matter is taken up for hearing today, there is no representation for the appellant. Learned counsel for the respondent 1/3

contended that the order in M.C.O.P.No.119/2017 was passed setting the respondent, the Tamil Nadu State Transport Corporation Limited, ex parte. Subsequently, the ex parte order was set aside and the trial is going on in M.C.O.P.No.119/2017 and therefore, nothing survives for further adjudication in the present appeal.

2. Recording the said submissions, the Civil Miscellaneous Appeal is dismissed. No costs.
