JUDGMENT

The Appeal suit arises out of grant of enhancement of compensation of the lands that were acquired.

2. It is to be noted that apart from the lands of the respondents, the lands of various other persons were also acquired on the very same notification. However, the Awards have been passed in parcels and in respect of the Awards in Award Nos.19, 16 & 18 of 2006 in respect of acquisition of lands in the very same village for the very same purpose, a Division Bench of this Court in an Appeal suits in AS.Nos.564 of 2011 and etc., batch had upheld the enhanced Award passed by the Reference Court, wherein the Reference Court has adopted the market value of Rs.16,500/- per cent for the lands acquired at Morai Village in the Notification dated 04.12.2003 issued under Section 4 of the Land Acquisition Act. This Court does not find any necessity to depart from the judgment of the Hon'ble Division Bench of this Court which also arise under the very same notification.

3. For the aforesaid reasons, this Court does not find any merits in the Appeal and accordingly, the Appeal stands dismissed. No costs. 20-04-2026 Index: Yes/No (3/3) Speaking/Non-speaking order GBA
