Civil Revision Petition filed Article 227 of Constitution of India, against the order passed in I.A.No.2 of 2023 in O.S.No.82 of 2021 by the learned Additional Subordinate Judge, Chengalpattu, dated 16.08.2023. For Petitioners : Mr.K.Selvakumar For Respondents : No appearance

ORDER

This civil revision petition is filed challenging the order passed by the Trial Court dismissing the application filed by the petitioners in I.A.No.2 of 2023 seeking reception of the document in respect of document Nos.2 to 8 1/4

filed along with the application.

2. The impugned order was passed by the trial Court mainly on the ground that the petitioner produced only photo copies of document Nos.2 to 8 which have been filed along with the petition.

3. The learned counsel appearing for the petitioner would submit except document Nos.2 and 4, all other documents are available with the petitioner either in original or in certified copy. Therefore, the petitioner is ready to mark the original/certified copy of the documents. The learned counsel also submits as far as the documents Nos.2 and 3 are concerned, if the original or certified copies are received by the petitioner, the same will be marked at the time of tendering the same in evidence. The said statement made by the learned counsel of the petitioner is recorded.

4. In view of the same, the impugned order passed by the trial Court is set aside and I.A.No.2 of 2023 is allowed insofar as the document Nos.2 to 8 filed along with the petition on condition that the petitioner shall 2/4

produce and mark original/certified copies of the document Nos.2 to 8 filed along with the petition at the time of marking. It is made clear, if the petitioner failed to produce original/certified copies, he is not entitled to insist for marking of the same.

5. With these conditions, the Civil Revision Petition stands allowed. Consequently, the connected miscellaneous petition is closed. No costs.
