This petition is filed to condone the delay of 852 days in filing the petition to set aside the order dated 02.07.2010 in respect of first respondent.

2. Heard the learned counsel appearing for the petitioner as well as second respondent.

3. Having satisfied with the reasons assigned in the affidavit filed in support of the petition, the delay is condoned and the petition is ordered.

4. Registry is directed to number the petition filed to set aside the order of dismissal against the first respondent and post the appeal on 06.11.2020.
