Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of mandamus directing the respondents to appoint the petitioner as Deputy Collector or any other posts included in Group-I Services in the vacancies of the Recruitment Year 2014-2015 in Notification No.9 of 2015 dated 10.07.2015 issued by the 1st respondent from the waiting list of the said recruitment selection list forthwith. ORDER
Mr. A.N.Thambidurai, learned Addl. Government Pleader takes notice for respondents 2 to 6 and Ms. C.N.G.Niraimathi, learned Standing Counsel takes notice for 1st respondent.
2. Pursuant to the notification in Notification No.9 of 2015 dated 10.7.2015 in respect of recruitment for the posts of the year 2014-2015 in Group-I services, the petitioner applied for the post of Deputy Collector and other Group-I posts. The petitioner, belonging to Backward Community, succeeded in the written examination held on 12.5.2017 and secured 507.50 marks. Subsequently, in the interview, the petitioner secured 81 marks. In all, the petitioner obtained an aggregate of 588.50 marks and was fully eligible to be appointed in Group-I posts. However, the petitioner was kept in the waiting list.
3. It is the case of the petitioner that though his name was found in the waiting list and that there are 5 posts vacant to be filled up, the petitioner has not been given appointment in one of the posts from and out of the list of candidates in the waiting list.
Therefore, the petitioner submitted a representation dated 10.12.2018 to the respondents to consider his case for appointment in one of the posts. Since no order has been passed on the said representation, the present petition has been filed.
4. Learned counsel appearing for the respondents submits that this Court may direct the 1st respondent to consider the representation and pass orders.
5. In view of the limited relief sought for, this Court is of the view that it would suffice to direct the 1st respondent to consider the representation dated 10.12.2018, submitted by the petitioner within a particular time frame.
6. In the above circumstances, this writ petition is disposed of by directing the 1st respondent to consider the
representation dated 10.12.2018, submitted by the petitioner and pass orders thereon, in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
