PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, directing the first respondent herein to dispose of the petitioner's appeal dated 16.12.2020 sent for cancelling the patta transferred in the name of "Asaf Hazarath Syed Sulaiman Shasadiri Dhargah" and to issue joint patta to the petitioner and her siblings in accordance with law and within a stipulated period. ORDER

This Writ Petition has been filed for issuance of a writ of mandamus, directing the first respondent herein to dispose of the petitioner's appeal dated 16.12.2020 for cancelling the patta transferred in the name of "Asaf Hazarath Syed Sulaiman Shasadiri Dhargah" and to issue joint patta to the petitioner and her siblings in accordance with law and within a stipulated period.

2. Heard, Mr.T. Vedi, learned counsel appearing for the petitioner and Mr.P.Baladhandayutham, learned Special Government Pleader appearing for the respondents 1 & 2.

3. The petitioner filed an appeal as against the issuance of patta in favour of the third parties in respect of the land comprised in S.F.No.364, 365 and 366 situated at Mookandapalli Revenue Village, Hosur Taluk, Krishnagiri District before the first respondent and it is pending.

4. Considering the above, the first respondent is directed to conduct enquiry on the appeal filed by the petitioner dated 16.12.2020, after issuance of notice to the petitioner and the counter parties, if any, by giving them an opportunity of hearing and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, the writ petition is disposed of. No costs.
