C.M.P.No.1753 of 2023 in C.M.A.SR.No.101 of 2023 SUNDER MOHAN,J.

This petition has been filed to condone the delay of 182 days in filing the above captioned C.M.A.

2. Mr.V.Sekar, the learned counsel for the petitioner submits that the delay is on account of the fact that the principal was unable to move from U.S.A due to the restrictions of Covid - 19 and hence, there was delay in obtaining instructions.

3. M/s.M.Benazir Begum, the learned counsel for the respondent vehemently opposed that the application for condonation of delay on the ground that the application filed for injunction is without any merit and the learned III Additional District Judge, Salem had commented upon the conduct of the appellant. 4.This Court is of the view that the same may be relevant for the purpose of the main appeal. Since I am satisfied with the reasons in the affidavit filed in support of this application, the delay is condoned. Hence, this petition is ordered as prayed for.
