( Criminal Jurisdiction ) Tuesday, the Eleventh day of January Two Thousand Twenty Two PRESENT The Hon`ble Mr Justice A.D.JAGADISH CHANDIRA CRIMINAL MISCELLANEOUS PETITION No.138 of 2022 IN CRL.R.C.No.894 of 2021 V.B.THIYAGA MOORTHY [ PETITIONER ] Vs S.LOKESH [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time to executing the sureties in Crl.M.P.No.12474 of 2021 in Crl.R.C.No.894 of 2021 order 08.12.2021 and thus render justice. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.M.PRABHAKAR, Advocate for the Petitioner the court made the following order:- Learned counsel appearing for the petitioner would submit that this Court, by an order dated 08.12.2021, while suspending the sentence had directed the petitioner to deposit 50% of the cheque amount within a period of two weeks from the date of receipt of a copy of that order.

2. He would further submit that the order copy was made ready on 13.12.2021, while, the petitioner was getting ready to deposit the amount, he had met with an accident and sustained fracture and he was hospitalized and thereby, he was unable to deposit the amount within a period of two weeks. However, since the Courts were closed for Christmas vacation, he was unable to file the petition seeking for extension of time and the petition has been filed immediately on the date of reopening the Court.

3. Considering the facts and circumstances of the case, time granted by this Court in Crl.M.P.No.12474 of 2021 in Crl.R.C.No.894 of 2021 by order dated 08.12.2021 is extended by further period of two weeks from today.

4. List the matter after three weeks for reporting compliance. -sd/- 11/01/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
