O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(2) of BNS Act, 2023 ( 417 of IPC) in Crime No.248 of 2025 on the file of the respondent Police, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner without having requisite qualification was running allopathic clinic. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner has studied various streams of medicines and hence he is entitled to practise allopathic medicines. He further submitted that, petitioner is ready to co-operate with the investigation. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner is not duly qualified and he is not entitled to practise allopathic medicine without obtaining proper qualification and registration from the appropriate authorities. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the nature of allegation that the petitioner without the requisite qualification was running allopathic clinic, if the petitioner is granted anticipatory bail, he will indulge in similar activities and it will endanger the safety of public and innocent persons, hence this Court is not inclined to grant anticipatory bail to the petitioner.
