ORDER

This Writ Petition has been filed seeking the issuance of a writ of mandamus directing the 1st respondent to process passport File No.CB1066672962924 and issue passport to the minor petitioner Henulaxan within a time frame stipulated by this Court.

2. The minor petitioner, Henulaxan, is represented by his mother and natural guardian. She was married to Vinod Kumar and out of the said wedlock, the minor petitioner was born on 15.11.2022 at Namakkal. Her husband passed away on 08.03.2024, as evidenced by the Death Certificate issued by the Namakkal Municipality. Thereafter, a legal Heirship Certificate was obtained on 14.10.2025, stating that she and her son are the legal heirs of the deceased Vinod Kumar. She submitted an application for the issuance of a passport on 11.06.2024 before the 1st respondent. Despite submission of all the requisite documents, the 1st respondent has neither issued the passport nor passed any order rejecting the application and has kept the application pending. Hence, the petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on record.

Considering the facts and circumstances of the case, and taking into account that the petitioner is a minor, and in the absence of any legal impediment, a writ of mandamus is issued directing the 1st respondent to process Passport File No. CB11066672962924 and issue a passport to the minor petitioner, Henulaxan, within a period of two weeks from the date of receipt of a copy of this order.

5. Accordingly, this Writ Petition is allowed as prayed for. No costs.
