ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 21.11.2021 for the offences under Sections 294(b), 307, 323, 324, 341, 392, 506(2) of IPC, in Crime No.583 of 2021 on the file of the respondent police seeks bail.

2. The case of the prosecution is that on 20.11.2021 at about 11.00 hours, the petitioner assaulted the defacto complainant with wooden log and hands and attempted to inflict cut injury on his head and snatched a sum of Rs.1,100/- from his pocket and also threatened him with dire consequences. Hence, the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case and there is no injury and that he has been suffering incarceration for 58 days from 21.11.2021. 4. The learned Additional Public Prosecutor raised strong objection stating that the petitioner is an rowdy element and he has taken Rs.1,100/- from the bag of the de facto complainant. He would further submit that the petitioner has got more than 10 previous cases.

5. On seeing the nature of allegation and the antecedents of the petitioner, if the petitioner is released on bail there is every possibility that he may abscond and tamper the evidences and there is no change in circumstance. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
