Prayer in Crl.O.P.No.9959 of 2011: This petition is filed under Section 482 of Criminal Procedure Code to call for the entire records pertaining to C.C.No.1400 of 2011 on the file of the Learned XXIII Metropolitan Magistrate Court at Saidapet and quash the same.

It is represented by the counsel for both the petitioners that in the dispute among the parties in the matrimonial affair, these above cases on counter have been registered long back. It is also represented that both the parties are not in India and they are residing in abroad and the counsels have expressed their difficulties in getting instructions with regard to the present stage.

2. In these circumstances, the counsels have also made an endorsement that they will work out their remedies before the Trial Court. Accordingly, these Criminal Original Petitions are disposed of with a liberty to the petitioner's counsel to raise all these points before the Trial Court.
