ORDER

Apprehending arrest in connection with Crime No.151 of 2024 registered for the offences punishable under Sections 306 and 3(5) of BNS, the present petition has been filed seeking anticipatory bail.

2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. He further submits that Rs.76 lakhs had already been recovered from the petitioner and he is ready to abide by any stringent condition that may be imposed by this Court.

3.The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that a sum of Rs.24 lakhs is yet to be recovered from the petitioner/A4 and that CCTV footage of ICICI Bank ATM would show that the petitioner is one among the group of accused, who had taken money and the second anticipatory bail application filed by the petitioner has been dismissed by this Court in Crl.O.P.No.28942 of 2024 on 03.12.2024 and that there is no change in circumstances. 5.Taking into consideration the fact that a sum of Rs.24 lakhs is yet to be recovered from the petitioner and also there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
