ORDER

The impugned order has been passed under Section 87 of the Tamil Nadu Co-operative Societies Act, 1983. The same is appealable under Section 152(1)(a) of the aforesaid Act. Since an effective alternative remedy of appeal is available and the appeal lies before the Principal District Judge, Cuddalore District and not before any administrative authority, I am not inclined to interfere with the same in exercise of jurisdiction under Article 226 of the Constitution of India.

2. As the order has been passed on 29.12.2020, during the outbreak of the Covid-19 Pandemic, the petitioner is entitled to the benefit of the orders passed by the Supreme Court extending the period of limitation. Consequently, the period of limitation for filing the appeal shall commence only from 01.05.2022.

3. It is open to the petitioner to explain to the learned Principal District Judge, the reasons which prevented him from filing the appeal within the prescribed time, in view of the pandemic and if sufficient cause is shown, the court shall consider the same liberally. __________Page 2 of 4
