JUDGMENT

This Appeal Suit had been filed challenging the enhanced award made by the Reference Court of the lands that were acquired from the 1st respondent. The land had been acquired for the purposes of formation of an outer ring road and the lands of the petitioner were situated at Thirumudivakkam Village. It is to be

noted that much extent of land were acquired for the formation of the outer ring road project in the very same village and was the subject matter of various awards which were all even dated 31.12.2001. It is also pertinent to note that the Division Bench of this Court had an occasion to deal with a batch of cases arising out of the enhancement of the award granted in respect of the lands situate in Thirumudivakkam village and confirmed the enhanced compensation arrived at by the Reference Court at Rs.8,000/- per cent.

2. A perusal of the judgment of the Division Bench of this Court dated 21.10.2011 made in A.S. Nos. 127 to 130 and 132 to 138 of 2011 would indicate that the Division Bench of this Court has confirmed the findings and reasonings of the Reference Court in arriving at the market value of Rs.8,000/- per cent and on such conclusion, had dismissed the Appeal filed by the Appellant, who is also the appellant in this Appeal Suit.

3. For the aforesaid reasons, the Appeal Suit stands dismissed confirming the award made by the Reference Court. No order as to costs. 27-04-2026 Index: Yes/No Speaking/Non-speaking order Maya
