PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to consider petitioner's representation dated 17.12.2019 and to give police protection and permission to conduct temple festival with cultural program (Orchestra) at Arulmigu Sri Uthama Raya Perumal Tiru Koil, at Periya Ayyampalayam, Arni Taluk, Thiruvannamalai District scheduled to be held on 18.01.2020. ORDER

This petition has been filed to direct the respondent to consider the petitioner's representation dated 17.12.2019 and to give police protection and permission to conduct temple festival with cultural program (Orchestra) at Arulmigu Sri Uthama Raya Perumal Tiru Koil, at Periya Ayyampalayam, Arni Taluk, Thiruvannamalai District scheduled to be held on 18.01.2020.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. The learned counsel for the petitioner has submitted that the petitioner has been appointed as organizing committee Member of the Arulmigu Sri Uthama Raya Perumal Tiru Koil, at Periya Ayyampalayam, Arni Taluk, Thiruvannamalai District . He further submitted that the said committee has decided to celebrate the temple festival on 18.01.2020 and at that time of 1/2 https://hcservices.ecourts.gov.in/hcservices/

said celebration, they want to conduct cultural programme (Orchestra) and hence the petitioner has submitted a representation dated 17.12.2019 before the respondent, but so far, no order has been passed on the said representation. Hence he requests to direct the respondent to pass an appropriate order on the said representation.

4. The learned Additional Public Prosecutor has submitted that in the previous years some untoward incidents took place and hence the respondent has not passed any order in the said representation.

5. Considering the aforesaid submissions, the respondent is directed to conduct enquiry by giving opportunity to the petitioner as well as the rival group if any, and pass order in accordance with law and dispose of the said representation and inform to both the parties on or before 10.01.2020. 5.With the above said directions, this Criminal Original Petition is disposed of.
