Prayer in CMP No.826 of 2026: Petition filed under Section 151 of Code of Civil Procedure, pleased to grant interim stay of all further proceedings in H.M.O.P.No. 2390 of 2024 now pending on the file Learned V Additional Judge, Family Court, Chennai.

ORDER

Heard.

2. This Transfer Civil Miscellaneous Petition has been filed by the petitioner / wife seeking transfer of the H.M.O.P.No.2390 of 2024, pending on the file of the V Additional Family Court, Chennai, to any other Family Court, having similar and competent jurisdiction.

3. The sole ground urged in the affidavit filed in support of the petition is that the petitioner is not willing to conduct the case before the present Presiding Officer of the V Additional Family Court, Chennai, where the H.M.O.P. is presently pending.

4. It is not in dispute that the Principal Judge, Family Court, Chennai, is competent to re-assign or redistribute cases pending before any of the Additional Family Courts at Chennai either to another Additional Family Court or to the Principal Family Court itself, as the case may be, in exercise of administrative control over the Family Court establishment.

5. If the petitioner had any genuine grievance against the Presiding Officer of the court where the case is pending, she had an effective and appropriate remedy 2/4

of ventilating such grievance before the Principal Judge, Family Court, Chennai. Without availing the said remedy, the petitioner has directly approached this Court by filing the present transfer petition.

6. This Court is of the view that such a practice of byepassing the available and efficacious authority cannot be encouraged, particularly when the relief sought pertains only to re-assignment of a case within the same Family Court establishment at Chennai.

7. In the above circumstances, the Transfer Civil Miscellaneous Petition is dismissed. However, it is made clear that it is open to the petitioner to approach the learned Principal Judge, Family Court, Chennai, if so advised, to work out her remedy in accordance with law. CMP No.826 of 2026 is closed. There shall be no order as to costs.
