The learned counsel for the petitioner made a submission that the Court fee had already been paid and the present miscellaneous petition is filed to condone the delay in paying the deficit court fee.

2. The appellant is unable to pay the entire court fee in view of some financial problems and subsequently, he mobilized funds and paid the Court fee which is required to be paid in the appeal suit. In view of the fact that the entire court fee had already been paid, the civil miscellaneous petition stands allowed.
