PRAYER: Appeal Suit filed under Section 96 of C.P.C against the Judgment and decree of the II Additional District Court at Erode dated 15.04.2013 in O.S.No.63 of 2011.

JUDGMENT

The learned Counsel for the Appellant submits that the Counsel had addressed a letter to the Registrar (Judicial) reporting that the subject matter of the Appeal had been settled out of Court. Therefore, requested the Court for withdrawal of the Appeal.

2. The learned Counsel for the Appellant submits that the amount had been deposited before the trial Court in O.S.No.63 of 2011 on the file of the learned II Additional District Judge, Erode. Since the Appeal is withdrawn, the learned Counsel for the Appellant seeks for withdrawal of the amount already deposited before the trial Court.

3. In the light of the letter addressed to the Registrar (Judicial) dated 18.09.2024 that the subject matter of the Appeal had been settled between the Appellant and the Respondent, the Appeal is disposed as withdrawn and the Appellant is entitled to refund of Court fee.

4. The learned II Additional District Judge is directed to refund the amount deposited on the file of the learned II Additional District Judge, Erode in O.S.No.63 of 2011 by the Plaintiff.
