PRAYER : Criminal Original Petition is filed under Section 482 Cr.P.C. directing the respondent Nos.1 and 2 to provide police protection to the petitioner and his family with regard to possession of his land to an extent of 0.50.5 comprised in S.No.30/4 and an extent of 0.48.5 in S.No.68/1 of Soodakondapalli Village, Hosur Taluk, Krishnagiri District. This Criminal Original Petition has been filed to direct the respondent Nos.1 and 2 to provide police protection to the petitioner and his family with regard to possession of his land to an extent of 0.50.5 comprised in S.No.30/4 and an extent of
0.48.5 in S.No.68/1 of Soodakondapalli Village, Hosur Taluk, Krishnagiri District.
2.The grievance of the petitioner is that respondent Nos.3 to 7 viz., Rajakumar, Venkatesappa, Thimmarayaswamy, Sivappa and Sathish are obstructing the peaceful possession and enjoyment of the petitioner's property of 0.50.5 hectare comprised in S.No.30/4 and an extent of 0.48.5 hectare in S.No.68/1 of Soodakondapalli Village, Hosur Taluk, Krishnagiri District. For which the petitioner had sent a complaint through post on 25.9.2021 and on 29.09.2021. Thereafter, no action has been taken by the respondent police. Hence he filed the present petition.
3.The learned Additional Public Prosecutor submits that the petitioner had sent a representation through post, no such complaint has been received by the respondent police and the veracity of the petitioner's complaint could not be verified. Therefore, the petitioner has to appear before the respondent police and produce the documents and on verification of the same, the respondent police would take appropriate action. 4.The learned counsel appearing for the petitioner on instruction submits that the petitioner would appear before the respondent police on 20.01.2022.
5.Considering the submissions and on perusal of materials, this Court directs the petitioner to appear before the respondent police along with the copy of the complaint and other documents in support of his complaint and to give his statement without fail on 20.01.2022. Thereafter, appropriate action would be taken by the respondent police.
6.With the above directions, this Criminal Original Petition is disposed of.
