ORDER

When the matter was taken up for hearing on 01.11.2019, there was no representation on behalf of the petitioner and hence the matter was directed to be listed on 05.11.2019 under the caption 'for disposal'.

Accordingly, today i.e. 05.11.2019 the matter is listed under the caption "for disposal", but, when the matter is called for hearing, there is no representation on behalf of the petitioner as well as the respondent. Even though the petition is pending from the year 2011 and the matter is listed under the caption "for disposal", there is no representation for the petitioner and hence this Court has no other way except to dismiss the same for non prosecution. This criminal original petition is dismissed for non-prosecution. Consequently connected miscellaneous petition is closed. However, since the maintenance case is pending from the year 2008, the learned District Munsif-cum-Judicial Magistrate, Parangipettai, is directed to dispose of the https://hcservices.ecourts.gov.in/hcservices/

maintenance case in M.C.No.7 of 2008 within a period of three months from the date of receipt of a copy of this order, if already not disposed.
