consequently direct the third respondent to reinstate the petitioner as Deputy Block Development Officer with effect from 31.07.2020 with all attendant benefits.

When the matter came up for hearing today, the learned Additional Government Pleader submitted that the petitioner herein was temporarily suspended from service on 31.07.2020 and the charges have been proved against him. He also submitted that the petitioner was not permitted to retire from service even though he has attained the age superannuation on 31.07.2022. He further submitted that since the petitioner's suspension was not revoked and charges framed under Rule 17(b) of the Tamil Civil Services (D & A) Rules, 1955 have not yet been confirmed and also that he was not given any pensionary benefits, the relief sought for by the petitioner in this Writ Petition, has become infructuous.

2. Recording the submissions made by the learned Additional Government Pleader, the Writ Petition stands dismissed as infructuous, as nothing survives for further adjudication in this petition. Consequently, connected Miscellaneous Petition is closed. There shall be no orders as to costs.
