PRAYER : Criminal Original Petition is filed under Section 439 Criminal Procedure Code praying to enlarge the petitioner on bail in Crime No.4000 of 2020 pending investigation on the file of the respondent.

(The case has been heard through video conference) The petitioners were arrested and remanded to Judicial Custody on 19.11.2020 for the alleged offence under Section 397 IPC in Cr.No.21 of 2020 on the file of the respondent police and seeks anticipatory bail.

2. The case of the prosecution is that the petitioners along with other accused waylaid the defacto complainant and robbed a sum of Rs.9500/- at knife point . Hence, the respondent police registered a case against the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having three previous cases, similar in nature. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the fact that the petitioner is having three previous cases, this Court is not inclined to grant bail to the petitioner.
