Respondents (the 2nd respondent is suo-motu impleaded as per order of this Court dated 18.04.2022 in Cont.P.No.374 of 2021) PRAYER : Petition filed under Section 11 of the Contempt of Courts Act 1971 to punish the respondent for the willful disobedience of the order in W.P.No.27747 of 2018 dated 10.12.2018.

ORDER

This Court, by an order dated 10.12.2018 in W.P.No.27747 of 2018 directed the first respondent herein to pay the compensation as enhanced in L.A.O.P.No.45 of 214 within a period of 3 months to the first petitioner herein, who is the sole petitioner in the writ petition. Since the order has not been complied with, the present Contempt Petition has been filed.

Today, when the matter is taken up for hearing, the learned Special Government Pleader, appearing for the respondent submitted that pursuant to the order passed by this Court, the Government sanctioned the compensation amount of Rs.34,82,794/- to the original owner/first petitioner herein, M.Paulraj.

3. The learned counsel for the petitioners submitted that after disposal of the writ petition, the original owner/first petitioner herein died on 04.03.2021 and now, the Government has sanctioned the compensation amount in the name of the original owner/deceased first petitioner herein. Hence, the Government may be directed to issue a cheque in favour of the legal heirs of the original owner/deceased first petitioner, i.e., petitioners 2 to 4 herein.

Considering the fact that the original owner M.Paulraj died, the petitioners 2 to 4 are directed to approach the District Collector/first respondent and give necessary application along with death certificate and legal heirs certificate of Mr.M.Paulraj. On filing such application, the first respondent is directed to issue cheque, to the legal heirs of the said Mr.M.Paulraj, namely, petitioners 2 to 4 herein, within a period of three weeks from the date of receipt of the copy of this order.
