Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the respondents 2 to 4 from interfering with the petitioner's peaceful possession, till final disposal of petitioner's representation dated 6.8.2020 pending before the 4th respondent for reclassification of land and issuance of patta in respect of land measuring to an extent of three cents comprised in S.No.311 situated at Somavarapatti Village, Udumalpet Taluk, Tiruppur District.

ORDER

The petitioner seeks a direction forbearing the revenue authorities from intervening with the petitioner's peaceful possession, till final disposal of petitioner's representation dated 6.8.2020 pending before the 4th respondent for

reclassification of land and issuance of patta in respect of land measuring to an extent of three cents comprised in S.No.311 situated at Somavarapatti Village, Udumalpet Taluk, Tiruppur District.

2. Heard both sides. Mr.E.Balamurugan, learned Special Government Pleader has produced a copy of the proceedings of the 4th respondent dated 12.01.2021.

Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the fourth respondent/Tahsildar to consider the representation of the petitioner, explore the feasibility of assigning the very land in Survey No.311 of Somavarapatti Village, Udumalpet Taluk, Tiruppur District, or where it is not feasible to explore the possibility to consider assigning any other properties, and if it is possible for him to do so, after conducting necessary enquiries the entire exercise shall be done in accordance with law and to dispose of the representation of the petitioner dated 6.8.2020, within a period of twelve (12) from the date of receipt of a copy of this order.

5. With the above directions, these writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
