This application has been filed taking advantage of Clause 14 of the Letters Patent, to combine the causes of action with respect to infringement of trademark and passing off.

2.In view of the fact that the issues overlap and necessarily common evidence will have to be let in, the application is allowed. It is also to be noted that the parties had already let in evidence in the suit.
