ORDER
This writ petition has been filed seeking for a direction to the respondents 1 and 2 to survey and demarcate the property, which according to the petitioner is owned by him, based on his online application dated 03.03.2025 within a time frame to be fixed by this Court.
2. The petitioner had submitted an online application on 03.03.2025 for the aforesaid purpose. Since the same has not been considered till date, the petitioner has filed this writ petition.
3. Mr. C. Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents 1 and 2. Mr.Venkatatesa Perumal, learned Government Advocate (Crl.Side) accepts notice on behalf of the respondent No.3. Since no adverse orders are passed against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with by this Court.
4. The learned Government Advocate appearing for the respondents 1 and 2 would submit, on instructions, that the property, for which survey and demarcation of boundaries is sought for through this writ petition has already
been sold by the petitioner in the year 2025. However, the same is disputed by the learned counsel for the petitioner.
5. This Court is not expressing any opinion on the merits of the respective contentions before this Court. Only in case where the petitioner is owning the property, survey and demarcation of the boundaries of the property can be done by the official respondents. It is for the petitioner to establish the same before the respondents 1 and 2.
6.No prejudice will be caused to the respondents 1 and 2 if the said authorities are directed to survey and demarcate the boundaries of the petitioner's property, morefully described in the prayer to this writ petition, after hearing the objections of the respondents 4 to 6 as well as the neighbouring land owners and any other party whom they deem it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the respondents 1 and 2 are directed to issue notice to the respondents 4 to 6 as well as the neighbouring land owners and also to any other party, whom they deem it fit to enquire. (b) After receiving objections if any and after considering the same, the respondents 1 and 2 shall conduct survey and demarcate the boundaries of the property,
morefully descried in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. (c) If the need arises for police assistance and on a request made by the respondents 1 and 2, the respondent No.3 shall render police assistance for the effective implementation of this order.
