and 1st petitioner respectively and situated in Attur Village, Hosur Taluk, Krishnagiri District which are not acquired by the 5th respondent and direct the 5th respondent herein to grant NOC to the petitioners for issuance of patta in their favour within a timeframe to be stipulated by this Honourable Court. 2.This writ petition has been filed to cancel the patta for the extent of 5 cents in Survey No.75/2, 6 cents in Survey No.75/4 and 6.60 cents in Survey No.75/3, standing in the name of the National Highways Department in respect of the properties, morefully described in the prayer to this writ petition, which according to the petitioners, are absolutely owned by them. 3.According to the petitioners, inadvertently, even though the aforesaid lands were not acquired by the National Highways Department, the aforesaid
lands, though belonging to the petitioners, are now included in the patta, standing in the name of the National Highways Department. The petitioners had given a representation on 01.12.2025 seeking for cancellation of patta, standing in the name of the National Highways Department for the aforesaid lands. The petitioners have filed supporting documents to substantiate their case before this Court. Since the said representation has not been considered, the petitioners have filed this writ petition.
4.Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents 1, 6 and 7. Ms.S.R.Sumathy, learned Standing Counsel accepts notice on behalf of the respondents 2 to 5. 5.This Court is not expressing any opinion on the merits of the petitioners' representation.
6.Since the Revenue Divisional Officer/Sub Collector, Hosur, Krishnagiri District is the competent authority to decide the applications seeking for cancellation of patta, the Revenue Divisional Officer/Sub Collector, Hosur, Krishnagiri District is suo motu impleaded as the party seventh respondent in this writ petition. Registry is directed to carry out the amendment accordingly.
7.No prejudice would be caused to the seventh respondent if the petitioners' representation, as stated supra is considered, on merits and in accordance with law, after hearing the objections of the respondents 2 to 5 and any other third party whom the newly impleaded seventh respondent deems it fit to enquire, within a time frame to be fixed by this Court. 8.For the foregoing reasons, this writ petition is disposed of by directing the newly impleaded seventh respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 01.12.2025 seeking for cancellation of patta standing in the name of the National Highways Department in respect of the lands, measuring an extent of 5 cents in Survey No.75/2, 6 cents in Survey No.75/4 and 6.60 cents in Survey No.75/3, situated in Attur Village, Hosur Taluk, Krishnagiri District, after hearing the objections of the respondents 2 to 5 and also any other third party whom the seventh respondent deems it fit to enquire within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
