ORDER
(Order of the Court was made by the Hon'ble Chief Justice) Shri Prabakar states a status report has been filed by respondent No.1. Shri Prabakar states Dr.Arun Thamburaj, who was the District Collector then, is now working as Mission Director, National Health
Mission, Chennai. Paragraphs 14 to 17 thereof, read as under: "14. It is submitted that in the meantime, 20 persons out of 21 persons whose pattas were cancelled, approached this Hon'ble Court and filed W.P.No.11645 of 2024 prayed that this Honourable Court may be pleased to issue of writ of CERTIORARI or any other appropriate writ or direction to call for the records, pertaining to the impugned order passed by the District Adi Dravidar and Tribal Welfare Officer in Roc W2/44468/2006, Dated 28.10.2016 and Quash the same as illegal and arbitrary. In the above W.P.No.11645 of 2024, this Hon'ble Court by its order dated 30.04.2024 passed the following order:
"Till the matter is decided by the Division Bench, the respondents shall maintain status quo".
It is submitted that necessary counter affidavit has been filed in the above Writ Petition No.11645 of 2024 and the matter is pending before this Hon'ble Court.
15. It is submitted that out of 54 beneficiaries who were issued with free house site pattas, Tmt.Vanitha and 16 others have filed W.P.No.12794 of 2024 before this Hon'ble Court praying for a direction to grant electricity connection to their houses, the Writ petition is pending before this Hon'ble High Court.
16. It is submitted that since the W.P.No.11645 of 2024 and W.P.No.12794 of 2024 related to the beneficiaries is pending before this Hon'ble Court, we could not proceed further.
17. It is respectfully submitted that, at no point of time, I have intended to violate or disobey any orders / directions of this Hon'ble Court. Despite this, if this Hon'ble Court comes to the conclusion that, I have disobeyed / committed contempt of the Orders of this Hon'ble Court, I tender my since and unconditional apologies."
2. In view of what is stated therein, we cannot come to the finding that there is a willful disobedience of the order passed by this Court.
3. Contempt petition is disposed of. There shall be no order as to costs. Consequently, Sub Application (OS) No.120 of 2024 also stands disposed of.
