PRAYER:

Writ petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the third respondent to grant permission for the installation of the idol of Lord Hanuman on 05.01.2019 and to carry on the peaceful procession of the Lord Hanuman Idol in the specified route on 07.01.2019.

ORDER

This petition has been filed seeking direction to install a Hanuman Statue and also carry on the procession on 07.01.2019.

2. According to the petitioner, they have proposed to take the Hanuman Jayanthi Festival on 05.01.2019 and also proposed to conduct the procession on 07.01.2019. For that purpose, he has filed an application before the second and third respondents from 08.12.2018. But, so far no order has been passed. Hence, the present writ petition has been filed.

3. Considering the fact that the petitioner's application is pending with the second respondent and the festival is going to be held tomorrow i.e., on 05.01.2019, the second respondent/Deputy Superintendent of Police, is directed to consider the application filed by the petitioner and pass suitable orders on merits and in accordance with law today itself.

4. The petitioner is also directed to appear before Deputy Superintendent of Police today at 5.00 p.m., and also submit his representation.

5. The learned Special Government Pleader, appearing for the respondents is directed to inform the Deputy Superintendent of Police to conduct enquiry and pass orders today itself.

6. With the above observations and directions, the writ petition is disposed of. No costs.
