This Criminal Original Petitions has been filed to call for the records and quash the entire proceedings in C.C.No.197 of 2016 (pending investigation) on the file of the Chief Judicial Magistrate Court, Erode

2. When the matter came up for hearing today, the de facto complainant is personally present before this Court and he is identified by the Investigating Officer.

3. Heard the learned counsel for the petitioners as well as the learned counsel for the second respondent and the learned Additional Public Prosecutor for the first respondent.

4. The learned counsel for the petitioners submitted that pending investigation in C.C.No.197 of 2016 on the file of the Chief Judicial Magistrate Court, Erode, de facto complainant and the petitioners have amicably settled the issue among themselves and to this effect, the de facto complainant has filed an affidavit dated 19.09.2017, stating that he has no objection if the proceedings in C.C.No.197 of 2016 on the file of the Chief Judicial Magistrate Court, Erode is quashed.

5. Recording the submissions made by the de facto complainant in his affidavit dated 19.09.2017, the proceedings in C.C.No.197 of 2016 on the file of the Chief Judicial Magistrate Court, Erode is quashed. Accordingly, the Criminal Original Petitions stands allowed. Consequently, connected miscellaneous petition is closed.
