v.

2017-11-16Honourable Mr Justice M. Sundar2 pages

W.P.No.8150 of 1991 M.SUNDAR.J., Read this order in conjunction with my earlier orders/proceedings dated 20.10.2017, 31.10.2017 and 07.11.2017. 2.There is no improvement today. In other words, there is no change in the situation/position today. As the Registry has not placed any report before me as directed in my earlier order/proceedings, in my opinion, the Registrar General should place the matter before Hon'ble Chief Justice for deciding if any proceedings are required on the Administrative side in this regard.

Therefore, this available file, containing the aforesaid earlier proceedings and this proceeding, shall be sent to the Registrar General for further action in this regard.

3. Be that as it may, this writ petition is of the year 1991. Therefore, this writ petition is more than 2 1⁄2 decades old in this Court. In my opinion, it may be of no use to show a writ petition as a pending writ petition when it is over a quarter century old, particularly when none of the parties have taken any efforts to get the matter listed.

4.To be noted, I am informed that none of the parties to the writ petition have taken any steps such as giving a letter to the Registrar Judicial for getting this matter listed. Therefore, this writ petition will stand dismissed for default/non-prosecution. Registry shall treat the previous orders /proceedings and the instant order as the case file for this writ petition and make a certified copy of this order. 5.Pursuant to such certified copy being made, Registry shall consequently delete this writ petition from the list of pending cases in this High Court in all Registers and systems. Most importantly, Registry shall ensure that this writ petition is deleted from the list of pending writ petitions in the National Judicial Data Grid (NJDG) forthwith. 6.I deem it just, fair and equitable to add that if any of the parties to this writ petition wake up and take steps to restore the writ petition to file, this Court shall take a more liberal and lenient view of the matter as it has been listed without the case file.
