O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, for direction directing the third respondent to issue patta in respect of the property comprised in S.No.63/11 admeasuring 3 acre 48 cents in Alagappa Samuthiram Village, Cuddalore District.

2. It is seen that the petitioner mortgaged the property owned by him and failed to redeem the said mortgage. The sixth respondent purchased the said property in a Court auction in the suit in O.S.No.494 of 1967 and the possession of the property was duly delivered to him. Thereafter, he sold the property to one Kumarasamy and all the revenue records mutate in his favour. The third respondent also issued patta in respect of the property in favour of the said Kumarasamy. Therefore, the application filed by the petitioner seeking issuance of patta became infructuous and nothing survives in this Writ Petition.

3. In view of the above, the Writ Petition stands dismissed. No costs.
