Chinnasamy (Died) v. Chinnapillaiammal,

CMP.Nos.1239 & 1240 of 2011 in SA.No.1087 of 2002 RMT.TEEKAA RAMAN,J., CMP.No.1239 of 2011 has been filed to set aside the abatement caused due to the death of the sole Appellant/ C.Chinnasamy in the second appeal.

CMP.No.1240 of 2011 to bring on record the legal heirs of the sole Appellant/ C.Chinnasamy as Appellants 2 & 3 and the respondents 17 to 19 respectively.

2.The factum of the death of the sole Appellant/ C.Chinnasamy in the appeal in S.A.No.1087 of 2002 as their legal representatives are not in dispute.

4.Though the notice served to the proposed respondents 1, 7 to 9 and 12 to 15 and the name of the respondents are printed in the caused list and being satisfied with the reasons stated in the affidavit filed in support of these applications, in the interest of justice, both applications are allowed.

5.Registry is directed to carry out the necessary amendment in the cause title.
