For Petitioner : M/S.J.JAYAPRAKASAM Advocate For Respondent : MR. R. SEKAR, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Petition for anticipatory bail in Crime No.1 of 2017.
2. Offences alleged are under Sections 498A, 494 and 506(i) IPC.
3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side).
4. Defacto complainant alleged that her husband Karthikeyan/A1 took another wife, while she is alive. Insofar as petitioner is concerned, she is stated to be married another woman's husband. Even in the FIR, there is no allegation that petitioner Revathi knows A1 married with defacto complainant. A1 is a cheater as per the allegation in the FIR. Revathi is not a cheater. A1 has a child through defacto complainant and he is also having a child through petitioner Revathi.
5. Considering the above aspects, I am inclined to grant her anticipatory bail.
6. Ordered as under:- (i) Anticipatory bail granted to the petitioner; (ii) Petitioner shall surrender before the learned Judicial Magistrate, Gudiyatham, Vellore District, within 15 days of receipt of a copy of the order;
(iii) Petitioner shall execute a bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;
(iv) Petitioner shall appear before the respondent police as and when required for interrogation.
