O R D E R

By consent of both the learned counsel appearing for the petitioner as well as respondents 1 to 3, this writ petition is disposed of at the admission stage itself.

2. The petitioner herein seeks a direction to the respondents 1 to 3 to issue Look Out Circular against the 4th respondent by considering petitioner's representation dated 03.12.2024.

3. It is the case of the petitioner that he made a criminal complaint against the 4th respondent for the offence under Section 420 of IPC and the 2/6

bail obtained by the 4th respondent was cancelled at the instance of the petitioner/defacto complainant in Crl.M.P.No.12731 of 2024. The said order was also confirmed by the Apex Court by dismissing the Special Leave Petition filed by the 4th respondent.

4. It is further stated by the petitioner that the 4th respondent is attempting to leave the Country and hence, the petitioner submitted a representation before the 2nd respondent on 03.12.2024 seeking necessary action to impound his passport and arrest him. The said representation has not been considered by the 2nd respondent till date. Hence, the petitioner has come before this court.

5. Mr.P.K.Ganesh, learned Central Government Counsel takes notice for the 1st respondent and Mr.L.Baskaran, learned Government Advocate (Crl.Side) takes notice for the respondents 2 and 3.

6. The learned Government Advocate (Crl.Side) appearing for the respondents 2 and 3 would submit that investigation in the matter is already completed and charge sheet has been laid in C.C.No.548/2024 on the file of 3/6

the Judicial Magistrate-II, Tiruppur and the case is posted for appearance of the accused on 20.02.2025.

7. Though the petitioner seeks a positive direction to the respondents 1 to 3 to issue Look Out Circular against the 4th respondent, this Court is not inclined to issue any positive direction to the respondents 1 to 3. However, the 2nd respondent is directed to consider the representation of the petitioner dated 03.12.2024 and pass final orders on its own merits and in accordance with law, within a period of two weeks from the date of receipt of copy of this order.

8. With the above direction, the Writ Petition stands disposed of. No costs. Consequently, the connected writ miscellaneous petition is closed. 10.01.2025 Index : Yes/No Speaking order:Yes/No dm 4/6
