ORDER

This petition has been filed for a direction to the respondents to forthwith appoint the petitioner as Noon Meal Organiser in the Panchayat Union Primary School at Bodinayakkanahalli Village, Udayandahalli Post, Denkanikotta Taluk, Krishnagiri District.

2. The case of the petitioner is that the petitioner is possessed S.S.L.C., qualification and belongs to Backward Class Community. The respondents had called for applications from eligible candidates for the post of Noon Meal Organiser at Panchayat Union Primary School at Bodinayakkanahalli Village, Udayandahalli Post, Denkanikotta Taluk, Krishnagiri District. Accordingly, the petitioner submitted her application along with

other required documents for the respondents consideration. The petitioner was called for interview in the office of the Kelamnagalam Panchayat Union Office, vide letter dated 27.07.2012. The petitioner participated in the interview and produced all her certificates. The petitioner was informed that appointment order would be sent within a few days. The grievance of the petitioner is that though she is an eligible candidate for appointment of Noon Meal Organiser, the respondents did not send any appointment order.

Enquiry revealed that the respondents have proposed to appoint one other person, who was not having the requisite qualification and was not eligible for appointment. Therefore the petitioner made a representation to the 1st respondent on 12.09.2012 to consider her case for appointment as Noon Meal orgasniser. There was no response from the respondents and their action is totally against the G.O.Ms.NO.163, Social Welfare and Nutritious Meal Scheme Dept,. Hence, left with no other option, the petitioner approached this Court by filing this writ petition with the above said prayer.

Though very many grounds have been raised in the writ petition, however, when the matter is taken up, learned counsel appearing for the petitioner submitted that it would suffice if this Court directs the respondents to consider the representation made by the petitioner to the post of Noon Meal Orgainser and pass orders within a particular time frame.

4. On the above contention, this Court heard the learned Special Government Pleader appearing for the respondents, who has no objections for issuance of such a direction.

In view of the limited relief sought for, this Court without going into the merits of the issue, directs the petitioner to submit a copy of the representation along with a copy of this order to the 1st respondent, within a period of two weeks from the date of receipt of a copy of this order and on such representation being filed, the 1st respondent is directed to consider the same and pass thereon in accordance with law within a period of three months therefrom.

5. With the above direction, this writ petition is disposed off. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
